Minnesota Intoxilyzer Source Code Lawyer & Attorney
Being charged with a DWI can change your life forever. That is why you must do whatever you can to have the charges dismissed or reduced. What you may not realize when you are arrested for DWI is that you have rights. And, there are ways in which you can refute the charges. One area that has been under scrutiny is the computer source code or software for the Intoxilyzer 500EN and whether or not it has played a role in individuals being falsely charged with DWI and/or test refusal.
The issue with the source code is that there are possible deficiencies in the source code itself. It is through these deficiencies that individuals have had their charges dismissed. That is, if they can prove that such possible defects have a direct impact on their case. Other evidence will be admitted into court that include the testimony of the officer, witness testimony, and any other evidence that could convict you outside of the results of the Intoxilyzer 500EN. DWI Attorney Max Keller has gotten may DWI charges dismissed or reduced when the prosecutor or the attorney general’s office failed to provide the Intoxilyzer Source Code when ordered to do so by a Judge. In either case, you do need an experienced Twin Cities DWI Lawyer by your side to make a strong case and work to have the charges dropped or the penalties reduced.
How The Intoxilyzer Works
When you breathe into the Intoxilyzer, infrared rays (a form of light) pass over your breath in the collection chamber and measure how much light was sent back versus how much it sent out. The Intoxilyzer is able to measure the amount of energy that was absorbed by your breath and can then give a reading regarding the amount of alcohol present. This is due to the fact that alcohol molecules consistently absorb the portion of the light. Unfortunately, other molecules similar to alcohol, such as paint thinner or varnish, also absorb light in the same part of the light spectrum as alcohol.
As for the issue with the Intoxilyzer 500EN source code, the very rigid commands are written by engineers and there are millions of combinations in which these commands may exist. These commands interpret the physical data, your breath, your alcohol content, how many times you breathed, what many liters of air you supplied to the Intoxilyzer, etc. that is given to the computer chip inside the Intoxilyzer and that cause it to makes it determination of whether you refused testing by not blowing hard enough, etc. or whether you failed the test (i.e. tested .08 or more).
How The Intoxilyzer Affects You
Even if the Intoxilyzer seems to be working perfectly when you blow into it, you may not have accurate test results. Being diabetic or being female are two factors among many that may actually alter the results. Lung capacity can also have an impact on the results. If you have big lungs, then you will provide your breath sample from the top of your lungs. If your lungs are small, you’ll be dipping further into your lungs for air. Those with smaller lungs can yield higher results (i.e. more “deep lung air”). Body temperature has also shown to have an impact on Intoxilyzer results.
